We purchased the apt community in 11/2019.Just received an email from David Feiss that the former owner was to obtain a variance for their pool and did not do so due to sale of property. This was not made known to us at time of purchase. The pool has two tanning decks and the turnover rate is 5.23 hours rather than 2 hours per code. We are asking for a permanent variance due to the hardship it will create to remove the pool deck and replace all lines to upgrade the existing circulation system.

Facts: |
|
*to obtain the proper flow for the tanning ledges we would have to install a much larger pool pump and in turn the existing pipes would not hold the force from the increased flow thereby requiring the entire pool deck to be demo-ed, re-install larger pipes and then install new pool deck creating undue hardship on the new owner.
