Conditions: A 2 hour fire barrier will be provided in lieu of a fire wall in order to separate buildings. Code  requires that a fire wall be provided when creating separate buildings. The project consists  of the partial demolition and rebuild/expansion of an MOB attached to a hospital. A majority of the separation wall is currently a 2 hour fire barrier that is not being demolished.

2= Applicant will undertake alternative actions in lieu of compliance with the rule to  ensure that granting of the variance will not be adverse to public health, safety, or  welfare.  Explain why alternative actions would be adequate (be specific).
Facts: 1. Both buildings will be provided with an automatic sprinkler system throughout.
2. The use of a 2 hour fire barrier is permitted by the 2012 Life Safety Code - NFPA 101  (enforced on this project by ISDH and CMS)
3. Similar variances allowing fire barriers in lieu of fire walls have been granted on numerous  healthcare facilities in the past (16-06-41, 18-08-29, 19-04-51 and 19-12-36 to name a few).
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.

Facts: The hardship would be the cost and physical limitations of demolishing the existing 2 hour fire barrier that is planned to remain in tact and in use in order to build a 3 hour fire wall. The 2  hour fire barrier currently serves as a separation between differing construction types. Also  the added components of a fire wall that include exterior wall extensions and opening  protectives (doors, windows, fire dampers).
