Conditions: A shaft enclosure will not be provided for the duct penetrating the floor assembly between  floors 5 and 6. Code requires any duct penetrations of fire rated floor assemblies in I-2  occupancies be enclosed within a shaft. The duct will be enclosed in a shaft on the 4th floor.

2= Applicant will undertake alternative actions in lieu of compliance with the rule to  ensure that granting of the variance will not be adverse to public health, safety, or  welfare.  Explain why alternative actions would be adequate (be specific).
Facts: 1. A fire damper will be provided where the duct penetrates the floor assembly between floors  5 and 6.
2. The building is provided with a sprinkler system throughout.
3. The design complies with Section 5.3.2 of NFPA 90A-2012 Standard for Installation of HVAC  Systems, as required by CMS and ISDH.
4. Similar variances have been granted in the past on other healthcare facilities (17-06-14,  18-02-04, 18-08-29, 19-05-32).

Facts: The hardship is the physical limitations of the layout and the cost to redesign the layout and  reroute the duct. The ductwork penetrates the 5/6 floor assembly, redirects and penetrates  the 4/5 floor assembly at a different location. This occurs in 2 locations. The design, without  the shaft enclosure, complies with the Life Safety Code as required by CMS and ISDH.
