Conditions: The current fire code limits the single tank capacity for Class II fuels (diesel)to 12,000- gallons. We are requesting a variance to allow the installation of (1) 15,000 gallon UL2085  Fireguard tank to meet the fueling demands of the truck fleet and to minimize the amount of  fuel deliveries required to meet demand
DEMONSTRATION THAT PUBLIC HEALTH, SAFETY, AND WELFARE ARE PROTECTED:
1=Non-compliance with the rule will not be adverse to the public health, safety or w

2= Applicant will undertake alternative actions in lieu of compliance with the rule to  ensure that granting of the variance will not be adverse to public health, safety, or  welfare.  Explain why alternative actions would be adequate (be specific).
Facts: A fire protected and ballistic rated UL2085 tank will be installed which provides a 2-hour fire  rating and a ballistics rating. The scheduled tank will have a secondary containment capacity  of 110% of the primary tank. The tank will also be monitored for leaks in the tank and piping via  a scheduled automatic tank gauge.
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.

  Imposition of the rule would result in an undue hardship (unusual difficulty)  because of excessive costs of additional or altered construction elements.

Facts: If variance is not granted the fuel demands of the fleet would be difficult to maintain.  Additionally, if the variance is not granted there will be an increased amount of deliveries and  fuel costs in order to meet fuel demands. The additional amount of deliveries required if  variance is not granted, will lead to additional potentials for fuel spills or releases.
