Conditions: The gates at the 1st floor level of the stairs will be removed which provide the barrier to  prevent persons from unintentionally proceeding to the basement from the 1st floor stair  landing.

The Stayer Center, completed in early 2013, is a 3-story + basement structure, and includes  educational, meeting, and administrative functions.

Facts: 1.  The exit doors from the stairs at the 1st floor landing are immediately apparent to  occupants descending the stairs from upper floors.  

2.  Exit signage and emergency lighting are provided in the stair, as required.  The building is  protected throughout with an automatic sprinkler system.

3.  Based upon the location of the exit doors from the stair enclosure with respect to the stair,  it is not likely that anyone would unintentionally continue to the basement level when  descending the stairs from the upper levels.
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.
