Conditions: Elements and spaces for use by fire fighting personnel, including bunk rooms, bathing/toilet
rooms, locker facilities, and kitchen area will not be designed for accessibility per Chapter  11,
IBC. The IBC requires all elements and spaces to be designed for wheelchair accessibility.

The project scope is construction of a new 3-story fire station.
DEMONSTRATION THAT PUBLIC HEALTH, SAFETY, AND WELFARE ARE PROTECTED:

2= Applicant will undertake alternative actions in lieu of compliance with the rule to  ensure that granting of the variance will not be adverse to public health, safety, or  welfare.  Explain why alternative actions would be adequate (be specific).
Facts: 1. The lack of accessibility for the elements noted will not be adverse to public welfare.

Accessible rest rooms will be provided for use by the public and staff personnel on the 1st  floor.

2. Emergency personnel are required by State law to be physically able as emergency  responders. All employment positions available to the physically disabled and areas  accessed
by the general public will be provided with fully accessible facilities, as required.

3. This variance has been granted numerous times previously for fire stations, including 06- 09-38, 06-10-39, 08-08-7(a), 09-05-22(b), 10-07-27, 10-09-19, 10-09-20, 10-09-21, 11-04-28,  11-06-25, and 11-09-63(b), 12-05-35, 14-05-19, 15-04-34, 15-04-54, 15-07-56, 16-05-12, 16- 07-63, 17-04-19, 17-04-54, 17-06-15, 17-09-13, 17-09-14, 18-06-18, 18-06-19, and others.
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.
