Variance Details | ||||||||||||||||||||||
Code Name: | 2005 Indiana Residential Code (675 IAC 14-4.3)
R302.1, R302.2 | ||||||||||||||||||||||
Conditions: | Please see the attached project summary. This variance request is an attempt to clarify, improve upon and correct a previously approved variance which was deemed too narrow of an approval to include critical components of the project design. The elements in question are two (2) re-located windows and a small section of in-fill exterior wall construction, both of which would be non-compliant with R302 if installed to match the existing construction now on site. |
|||||||||||||||||||||
DEMONSTRATION THAT PUBLIC HEALTH, SAFETY, AND WELFARE ARE PROTECTED:
1=Non-compliance with the rule will not be adverse to the public health, safety or w
1 | ||||||||||||||||||||||
2= Applicant will undertake alternative actions in lieu of compliance with the rule to ensure that granting of the variance will not be adverse to public health, safety, or welfare. Explain why alternative actions would be adequate (be specific). |
||||||||||||||||||||||
Facts: | A variance to R302 has already been approved for the existing building, which has been moved from one site to another. The approval of the final components, which we believe should have been considered as an included part of of the original submission, would complete the originally intended scope of the project and allow for the building to be fully restored as originally planned. |
|||||||||||||||||||||
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty) because of physical limitations of the construction site or its utility services. |
||||||||||||||||||||||
Imposition of the rule would result in an undue hardship (unusual difficulty) because of major operational problems in the use of the building or structure. |
||||||||||||||||||||||
Y | Imposition of the rule would result in an undue hardship (unusual difficulty) because of excessive costs of additional or altered construction elements. |
|||||||||||||||||||||
Imposition of the rule would prevent the preservation of an architecturally or a historically significant part of the building or structure |
||||||||||||||||||||||
Y | ||||||||||||||||||||||
Facts: | The cost associated with the scope of work required to meet current code, including:
1) Replacement of +/- 120 sq. ft. of exterior wall with one-hour fire-rated wall construction; and 2) Replacement of existing windows with fire rated windows to match the original configuration; would cost approximately $8,500. This cost is an excessive amount given the fire safety value provided by such a limited amount of exterior wall area. |
