Conditions: Two (2) unisex single-occupant rest rooms will be provided in lieu of separate male and  female rest rooms for the restaurant tenant space.

The project involves a 1st floor tenant space build-out on the 1st floor of the Cummins Office  building.

Facts: 1.  Per Sec. 1109.2, exc. 3, for clustered single-occupant rest rooms, one (1) of the rest  rooms will be fully accessible.

2.  A very similar variance was granted for a restaurant tenant in 2015 (15-11-31). 

3.  Other variances have been granted to permit unisex rest rooms in lieu of separate male  and female rest rooms, including 17-03-34a and 17-01-21. 
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.

Facts: The available location for rest rooms in the tenant space is limited by a number of factors  related to the existing configuration of the tenant space.  These factors include the fact that  the kitchen, cooking line, and service line will need to be located within the interior of the  tenant space due to exterior window walls on 2 sides of the tenant space.  Additionally, the  locations of exits from the space are dictated by the existing configuration.  Based upon the  factors noted, the provision of two (2) fully accessible male and female rest rooms is not  feasible.  The use of non-gender specific rest rooms is also a desired feature of this brand.   Public Greens is a non-profit restaurant, with another location currently in Broad Ripple.
