Conditions: Electrical cable penetrations of floors are not either within a fire-rated shaft, nor can tested  firestop assemblies protect the penetrations based upon the configuration of the as-built  condition.
The project scope is construction of a 4-story Type VA apartment structure on top of a 1- story plus basement Type IA podium structure used as a parking garage.  There is also a  connected 2-story bank branch building of Type IIB Construction.

Facts: 1.  An alternative system of protection will be developed based upon adaptation of similar  firestop assemblies and materials.

2.  The building is protected with an automatic sprinkler system.

Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.

Facts: Given the progress of construction, it is not feasible at this point in time to identify a listed  assembly to remedy the as-built condition.  Areas identified on the plans to be used as fire- rated shafts were not constructed as fire-rated shafts.  The penetrations must now be treated  as floor penetrations.
