Conditions: The wall enclosing the atrium will also serve as the corridor wall at the 2nd floor. The  variance request is to permit the wall to be constructed as a smoke partition with windows in  a gasketed frame and protected by a sprinkler in lieu of fire-rated corridor construction. 

The building is a new4-story assisted living facility, I-1 Occupancy. The building is 4-stories  and Type VA Construction. The building is protected throughout with an automatic sprinkler  system in accordance with NFPA 13.

Facts: 1. The building will be protected throughout with an automatic sprinkler system in accordance  with NFPA 13.

2. A fire alarm system will be installed throughout the building.

3. Smoke detection will be provided throughout the corridors and areas open to the corridor.

4. Protecting the opening as required for an atrium is not adverse to public health, welfare, or  safety.

Facts: The hardship is the cost to provide rated openings in wall that is protected as required for an  atrium in a building protected throughout with an NFPA 13 sprinkler system. The owner wishes to maintain the openness of this portion of the building to help make the assisted living facility  feel less institutional.

The code permits anchored masonry veneer with a backing of cold-formed steel framing to  be a height of 30 feet above a noncombustible foundation. The code requires the weight of  any anchored masonry veneer above this height to be supported by noncombustible  construction for each story above 30 feet in height from the noncombustible foundation.  

The proposed height of the veneer above the noncombustible structural support system is  approximately 38 feet.

Facts: According to the attached letter and analysis from the structural engineer the proposed  design is acceptable and will not be adverse to safety. 

This variance has been granted for other similar projects including: 14-04-19(d), 12-09-33(a), 10-11-24, 08-06-02, 08-04-07(d), 07-09-31, and 06-11-58(d).
