Conditions: A new interactive fountain "splash pad" at Fishers Central Green will not have a rinse off  shower.  Code requires a rinse off shower for independent splash pads. 

The project involves the addition of a splash pad adjacent to a new community pavilion.  The  splash pad is approximately 1,936 sf with 18 fountain nozzles.

Facts: 1. The splash pad is zero depth with no standing water.   
2. The splash pad is not intended to be a busy pool type attraction.  It is a decorative  interactive water feature that will likely be entered by people that are visiting the park for other  purposes, not visiting with sole intent to play in the splash pad.   A shower would not be likely  to be utilized.
3. Restrooms and drinking fountain will be provided inside the adjacent pavilion.
 
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.
