Conditions: The latch side door clearance from within each of the two (2) new rest rooms created within  the existing building includes knee and toe clearance from the adjacent lavatory.  The 2009  Edition of the A-117.1 Standard prohibits the inclusion of knee and toe clearance within the  clear floor space for door access.
The project involves renovation of the existing building for use as a funeral home.  The  building is classified as A-3 Occupancy.
DEMONSTRATION THAT PUBLIC HEALTH, SAFETY, AND WELFARE ARE PROTECTED:

Facts: 1.  The door is not provided with a closer, thus providing greater ease in operation of the door from within the room.  
2.  The inclusion of knee and toe clearance within this clear floor space was not prohibited in  neither the 2003 A-117.1 Standard, nor in the 2010 ADA Standards.

Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.

Facts: The new rest rooms provide a significantly greater degree of accessibility than the previous  rest rooms.  The rest rooms are constructed. Remedy for this condition would at this point  require moving walls and plumbing fixtures - and would eliminate needed space in the lobby  and showing room.
