Facts: Casey's does not have a vestibule in any one of their 1,950 stores in 15 states. There has  never been an incident recorded related to the public health, safety, or welfare of its patrons  due to the exclusion of a vestibule. Patrons do not complain about the lack of, or request the  addition of a vestibule.
All requirements of current code for fresh air intake and exhaust air are satisfied. There is no  pressurized space in the public area of the building.

Imposition of the rule would result in an undue hardship (unusual difficulty)  because of physical limitations of the construction site or its utility services.

Facts: Casey's building designs are similar in nature across the 15 states. Floor plans and  equipment layouts are unified.  There is no space allowed either inside or outside the front  door to accommodate the addition of a vestibule.  Imposition of this rule would increase  development costs as it would force a unique design to the building and require unique  equipment, as space is currently otherwise accounted for.
Imposition of this rule would disrupt the flow of patron traffic.  Casey's patrons are  accustomed to the convenience of the floor layout. A vestibule would confuse that routine.
