Variance Details | ||||||||||||||||||||||
Code Name: | Other Code (Not in the list provided)
2014 IBC Sec. 1021.1 | ||||||||||||||||||||||
Conditions: | Both existing interior stairs from the 3rd floor are unenclosed exit access stairways. Code requires at least one enclosed exit stairway from stories above the 2nd story.
The project involves conversion of an existing 3-story building to offices. The building is classified as Type III-B Construction and has approximately 7,882 sf on the 1st and 2nd floors, 1,358sf on the 3rd floor and a 1,358sf mezzanine above 2nd floor. The building will be classified as Group B Occupancy. |
|||||||||||||||||||||
DEMONSTRATION THAT PUBLIC HEALTH, SAFETY, AND WELFARE ARE PROTECTED:
1=Non-compliance with the rule will not be adverse to the public health, safety or w
1 | ||||||||||||||||||||||
2= Applicant will undertake alternative actions in lieu of compliance with the rule to ensure that granting of the variance will not be adverse to public health, safety, or welfare. Explain why alternative actions would be adequate (be specific). |
||||||||||||||||||||||
Facts: | 1. The existing open stairs are only 1 level above the level of exit discharge.
2. Exit discharge is provided from the 2nd floor level, which meets the intent of the requirement for stories above 2nd story to have one exit. 3. Exit access configuration will comply with Section 1015.2. 4. Exit access travel distance is less than half of the maximum permitted (86 feet vs. 200 permitted) |
|||||||||||||||||||||
DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE:
Imposition of the rule would result in an undue hardship (unusual difficulty) because of physical limitations of the construction site or its utility services. |
||||||||||||||||||||||
Y | Imposition of the rule would result in an undue hardship (unusual difficulty) because of major operational problems in the use of the building or structure. |
|||||||||||||||||||||
Y | Imposition of the rule would result in an undue hardship (unusual difficulty) because of excessive costs of additional or altered construction elements. |
|||||||||||||||||||||
Imposition of the rule would prevent the preservation of an architecturally or a historically significant part of the building or structure |
||||||||||||||||||||||
Facts: | The stairways are existing. It would be difficult and costly to relocate existing stairs/add new stairs to provide direct exit discharge, while the intent of the code is met with 2 exit access stairways. |

2014 IBC Sec. 3412.6.7 | ||||||||||||||||||||||
Conditions: | The building will be evaluated using Section 3412 in lieu of compliance with all of the requirements for new construction. The variance request is to allow a score of 5 points for HVAC systems without providing separate systems for each story.

||||||||||||||||||||||
Facts: | 1. Smoke dampers will be provided in ductwork penetrating the floor/ceiling assembly between the 2nd and 3rd floors to prevent smoke spread between floors. The 1st and 2nd floor will be served separately. This will meet the intent of Section 3412.6.7 category e for systems serving a single story.
2. Smoke detection will be provided throughout the building. 3. A manual fire alarm system in accordance with Section 907 will be provided throughout the building. 4. Exit signage and emergency lighting will be provided per current code. 5. Maximum exit access travel distance is less than 100 feet - code permits up to 200 feet. 6. Similar variances have been granted in the past (15-07-15, 15-09-29, 16-01-15(a), 16-04- 20) |

||||||||||||||||||||||
Facts: | The hardship is the cost of adding separate HVAC systems in the existing building, while the installation of smoke dampers will achieve the same level of protection by preventing the movement of smoke throughout both stories |
