Operation without permit or special event endorsement; infraction Sec. 5. (a) This section applies to the following: (1) Each person who has control over the performance of an amusement or entertainment described in IC 22-12-1-23. (2) Each person who has control over a regulated place of entertainment. (b) A person described in subsection (a) commits a Class C infraction if: (1) a regulated place of amusement or entertainment is used for an amusement or entertainment described in IC 22-12-1-23; and (2) no regulated place of amusement or entertainment permit or special event endorsement issued under this chapter covers the conditions at the regulated place of amusement or entertainment that affect fire and explosion safety.  
The facility is renting out space in which entertainment is being held at that requires an Amusement and Entertainment Permit.

675 IAC 12-4-9(a) 
All buildings and structures, and any part of the permanent heating, ventilating, air conditioning, electrical, plumbing, sanitary, emergency detection, emergency communication, or fire or explosion systems, and all parts thereof, shall be maintained in conformance with the applicable rules of the commission, or applicable rules of its predecessor agencies, in effect when constructed, installed, or altered. 
A handrail located along the stairs between the 1st floor and basement was found not completely secured to the wall. 
 
 

Sec. 901.6.2 2014 Edition IFC 675 IAC 22-2.5 
Records of all system inspections, tests and maintenance required by the referenced standards shall be maintained on the premises or made readily available for a minimum of two (2) years from the date of the last inspection, except that original acceptance test reports shall be maintained for the life of the system. 
Copies of the Fire Alarm, Sprinkler, and Hood suppression system inspection reports could not be provided at the time of inspection.

Sec. 901.6.1 2014 Edition IFC 675 IAC 22-2.5 
Fire protection systems shall be inspected, tested and maintained in accordance with the referenced standards listed in Table 901.6.1. 
Documentation could not be provided to show that the Fire Alarm is being inspected at the required intervals. The main panel also indicated a trouble at the time of inspection. 
 
 

Sec. 703.1 2014 Edition IFC 675 IAC 22-2.5 
The required fire-resistance rating of fire-resistance-rated construction (including walls, firestops, shaft enclosures, partitions, smoke barriers, floors, fire-resistive coatings and sprayed fire-resistant materials applied to structural members and fire-resistant joint systems) shall be maintained. Such elements shall be visually inspected by the owner annually and properly repaired, restored or replaced when damaged, altered, breached or penetrated. Where concealed, such elements shall not be required to be visually inspected by the owner unless the concealed space is accessible by the removal or movement of a panel, access door, ceiling tile or similar movable entry to the space. Openings made therein for the passage of pipes, electrical conduit, wires, ducts, air transfer openings and holes made for any reason shall be protected with approved methods capable of resisting the passage of smoke and fire. Openings through fire-resistance-rated assemblies shall be protected by self- or automatic-closing doors of approved construction meeting the fire protection requirements for the assembly. 
Ceiling tile in, but not limited to, the sprinkler riser room and table storage room were found out of place or completely missing.

Sec. 703.3 2014 Edition IFC 675 IAC 22-2.5 
The hanging and displaying of salable goods and other decorative materials from acoustical ceiling systems that are part of a fire-resistance-rated floor/ceiling or roof/ceiling assembly, shall be prohibited. 
A hanging item was found suspended from the ceiling grid in the library. 
 
 

Sec. 315.3.1 2014 Edition IFC 675 IAC 22-2.5 
Storage shall be maintained 2 feet (610 mm) or more below the ceiling in nonsprinklered areas of buildings or a minimum of 18 inches (457 mm) below sprinkler head deflectors in sprinklered areas of buildings. Exception: Sidewall storage to a maximum depth of thirty (30) inches (seventy-six and two-tenths (76.2) centimeters) shall be acceptable to the ceiling in nonsprinklered buildings. 
Storage in, but not limited to, the riser room, table storage room, and closet under that stairs; was found to be within 18" of the sprinkler deflectors and shall be lowered.

Sec. 807.1 2014 Edition IFC 675 IAC 22-2.5 
In occupancies in Groups A, E, I and R-1, and dormitories in Group R-2, curtains, draperies, hangings and other decorative materials suspended from walls or ceilings shall meet the flame propagation performance criteria of NFPA 701 in accordance with Section 807.2 or be noncombustible. Exceptions: 1. Curtains, draperies, hangings and other decorative materials suspended from walls of sleeping units and dwelling units in dormitories in Group R-2 protected by an approved automatic sprinkler system installed in accordance with Section 903.3.1 and such materials are limited to not more than 50 percent of the aggregate area of walls. 2. Decorative materials, including, but not limited to, photographs and paintings in dormitories in Group R-2 where such materials are of limited quantities such that a hazard of fire development or spread is not present. In Groups I-1 and I-2, combustible decorative materials shall meet the flame propagation criteria of NFPA 701 unless the decorative materials, including, but not limited to, photographs and paintings, are of such limited quantities that a hazard of fire development or spread is not present. In Group I-3, combustible decorative materials are prohibited. Fixed or movable walls and partitions, paneling, wall pads and crash pads, applied structurally or for decoration, acoustical correction, surface insulation or other purposes, shall be considered interior finish if they cover 10 percent or more of the wall or of the ceiling area, and shall not be considered decorative materials or furnishings. In Group B and M occupancies, fabric partitions suspended from the ceiling and not supported by the floor shall meet the flame propagation performance criteria in accordance with Section 807.2 and NFPA 701 or shall be noncombustible. 
Draperies were found hung on the walls in multiple rooms on the first floor, however, documentation could not be provided to show that they meet the proper flame propagation requirements of NFPA 701. 
 
 

Sec. 604.5.2 2014 Edition IFC 675 IAC 22-2.5 
For battery-powered emergency lighting, a power test of the emergency lighting equipment shall be completed annually. The power test shall operate the emergency lighting for a minimum of 90 minutes and shall remain sufficiently illuminated for the duration of the test. 
Documentation could not be provided to show that the required annual 90 minute load test has been performed.

Sec. 906.9.1 2014 Edition IFC 675 IAC 22-2.5 
Portable fire extinguishers having a gross weight not exceeding 40 pounds (18 kg) shall be installed so that their tops are not more than 5 feet (1524 mm) above the floor. 
Fire extinguishers located throughout the basement gathering area were found to have been installed in excess of 5' from the floor.

7.2.1.2* Fire extinguishers shall be inspected either manually or by means of an electronic monitoring device/system at a minimum of 30-day intervals. 
The monthly fire extinguisher inspections are not being completed as required.

Sec. 605.3.1 2014 Edition IFC 675 IAC 22-2.5 
Doors into electrical control panel rooms shall be marked with a plainly visible and legible sign stating ELECTRICAL ROOM or similar approved wording. The disconnecting means for each service, feeder or branch circuit originating on a switchboard or panelboard shall be legibly and durably marked to indicate its purpose unless such purpose is clearly evident. 
The door leading into the main electrical room has not been labeled to indicate it as an Electrical Room.

Sec. 605.5 2014 Edition IFC 675 IAC 22-2.5 
Extension cords and flexible cords shall not be a substitute for permanent wiring. Extension cords and flexible cords shall not be affixed to structures, extended through walls, ceilings or floors, or under doors or floor coverings, nor shall such cords be subject to environmental damage or physical impact. Extension cords shall be used only with portable appliances. 
The flexible power cord serving the overhead projector in the main gathering area and an extension cord located in the kitchen were both found passing through the ceiling. The extension cord located in the kitchen also appeared to being used as permanent wiring.
